引越しのため ３０日のNOTICEをアパートに出した場合 それをキャンセルする事は出来ないのでしょうか？ アパートのマネージャーに聞いた所 出来ないとの事で ではそれを証明するものを見せてくれといっても何も見せてくれません 実際私の知り合いは他のアパートで３０日NOTICEの 日の一週間前に キャンセル出来た人も居ます レンタルアグリーメントの用紙を読んでも全くキャンセルについては書いてありません カリフォルニアの法律では キャンセル出来ないのでしょうか？ 良いアドバイス宜しくお願いします

法律っていうのを誤解されている人が多いので少し・・・法律っていうのはズバリ全てのケースについて答えは書いてありません。最低限のルールが書かれてあるだけで、ほとんどがケースバイケースで運用されます。
なぜ３０日前に退去する旨をマネージャーに知らせるのか？アパートメントの家賃収入の空白状態をなるべく作らないため・・・
つまり、まだ次の契約者が見つかってない状態では、トピ主さんのお知り合いの方みたいにキャンセルが可能な場合も出てくるんでしょうけど、たぶんトピ主さんの場合は次の契約者がキャンセルの意思をマネージャーに伝えるよりも先に見つかったんでしょう。。。
出ると言ったから、マネージャーは次の入居者を探して合法に契約した・・・そのあとにキャンセルしたいんですけど・・・って言っても、もう次の契約者が来月から住むという契約をしたんだから、トピ主さんの入り込む余地はありませんね。。。
早く次の住むところを探さなきゃ！

＃２さんの言われる通り、多分次の人が見つかってしまった、と思います。そうでない限りアパートなんて人がすみつづけてくれるに越したことはないですからね、迷惑な人でない限り。だからもしそうなら法律とかではなんともできないと思います。がんばって部屋を探す方がいいと思いますよ。それかマネージャーに他の部屋は空いているか？とかその新しい人と交換できるかとか・・・。
