Vivinavi Los Angeles日米において離婚によるお金

アメリカで結婚して20年。ソシテ日本にも結婚届は出してあります。そこでいまアメリカで離婚をしたら今までの財産は５０％、５０％ となり子供も成人しているから争うこともないと。
ただ最近夫の日本にいる父がなくなり≪母は他界≫相当の財産を弟と半分となりました。。その遺産をうけた夫のお金はその嫁が日本でも離婚手続きをすればやはりアメリカと同じように遺産のお金も半分請求できるのでしょうか?
それとも日本における共有の財産のみなのでしょうか?

カリフォルニアでは、離婚の際夫婦が共に築いた財産は等分し、結婚以前に配偶者が親から相続した財産は等分出来ない筈です。トピ主さんの場合みたいに配偶者が最近相続した財産は定かでないですが、下のウェブサイトの、日本の岡田一三弁護士が時々カリフォルニアに来れられて日本の不動産相続等の相談を受けていると日系スーパーに置いてある無料の雑誌か何かで見た事がありますので、問い合わせされたらどうでしょうか。

質問者さんの期待に反する回答で申し訳ないですが、カリフォルニアでは配偶者が受取った遺産は、婚姻中に受け取ったものでも、separate propertyになりますので、夫婦の共有財産にはなりません。なぜ共有財産にならないかというと、質問者さんには、配偶者が受取った遺産の相続権がもともとないからです。これは日本でも同じ扱いになります。しかしながら、配偶者が遺産を投資したりして出来た利益は共有財産に含める可能性があります。

配偶者が受け取った遺産は財産分与の対象にはなりません。日本でもアメリカでもいっしょです。結婚前の財産も対象になりません。
