現在、Exemptの営業職で日系企業で働いています。営業といっても社内にいる時が多く大体がきっちり8-5時社内で仕事してます。米国内および海外への出張時には土曜日、日曜日に移動するように上から要求され、土日に出張移動しています。その場合、会社ではカリフォルニア州の法律では代休が出せないと言われていますが本当でしょうか。何とか会社から代休をもらえる方法ありますか、アドバイスお願いします。

すみません、訂正させて下さい。まずCAのExemptのサラリーは最低年収$41,600です。
アメリカのどの会社も土日の出張に対する代休または特別手当など無いのでしょうか。
会社に寄ります。その会社のポリシー次第です。
アメリカの他社で代休、または特別手当などあればそれを例に会社に交渉したいです。
ポリシーと言っても会社の規模にも大きな違いがありますので、同じフィールドの同じ規模の会社のポリシーを探してみる、ですね。頑張って下さい。
”会社によってはその時間を代休に使ってもよいポリシーがあります。”とありますが、出張移動による土日の出勤も含まれますか？
再度、出張移動による土日の出勤も含まれるかどうかは、各々の会社次第(会社によっては)です。
そうであれば州法に基づいて代休を取れる気がしますが？
州法にあるExemptのサラリーは最低年収$41,600ですが、代休ほしいさんはそれ以下の年収でExemptになっているのですか?それならば"州法に基づいて"できれば専門家に１度相談をして交渉もありかとは思います。でも年収$41,600以上であれば、会社側は州法に違反してはいません。

社員が26人以上の会社ではExemptの年収は2017年は$43,680、2018年は$45,760で、社員が25人以下の会社ではExemptの年収は2017年は$41,600、2018年は$43,680が正確な金額です。ですが、その金額に満たさない"Exempt"が多いのも事実です。

このHR関係って方、以前最低賃金の値上げのトピがあがった際間違った情報をつらつらと書いていたので、この人の言う事はあまりあてにしない方がいいと思いますよ。
