Vivinavi Los AngelesＯＰＴからＨ−１への切り替え

アドバイスお願いします。私はＯＰＴが昨年の１２月で終了しＩ−２０も同時に切れました。Ｆ−１自体は今年の９月まであります。ＯＰＴで働いていた会社が全面的にビザサポートしてくれると言ってるのですがＨ−１の申し込みは４月だそうで。その間（Ｈ−１取得できるまで）出国しなければ違法滞在にならないでしょうか？父が高齢なので何かあったときにすぐ帰国でくるよう違法滞在はどうしても避けたいのですが。Ｈ−１がだめでもＪビザとかでインターンとして今の会社にサポートしてもらえたりするのでしょうか？

確か、Ｉ−２０が切れた時点でＦ−１も無効になってしまうはずですよ。Ｉ−２０というSupporting Documentがあるからこそ有効なのが、Ｆ−１のはずです。
ＯＰＴ、Ｉ−２０が切れてしまっているということは要するに違法滞在になってしまうと思いますよ。
Ｊビザもいいかと思いますが、あれは本当に短期間用の、国に帰るということが前提のはずなので、どうかと思いますが。知り合いにはＪビザからのＨ１は結構大変という話も聞いています。

12月でOPTが切れているのなら、切れた日から数えて60日以内に出国しなければ、オーバーステイです。H-1は4月から申請できますが、承認されても合法的に働けるのは、10月1日からです。ですので、60日以内に国外退去して、日本からH1-bの申請をしなければなりません。ビザを申請するにあたり合法的なステータスがないと却下されます。
