Hビザの取得では平均給与の支払い義務がありますよね?
日系企業の場合、信じられないくらい給料が安いけどどういうことなんでしょうか?明らかに平均給与を下回ってるのに違反にならないんですか?

弁護士さんと確認されたほうがいいかと思いますが、私の知る限りではHビザの賃金レベルがあり時給＄１８．００位だったと記憶しています。なので私の勤めている会社ではHビザのスポンサーはしていません。本当に時給＄１８．００のポジションでどうしても必要な人ならば別ですが。
たぶん、Hビザを申請したときの用紙にはそれ位の時給で採用する旨が記されている筈で、Auditが入ると実際の時給がたとえば＄１３．００であれば、問題になるそうです。
でも、もしこれが本当だとして、nocturne12さんはどうされるおつもりですか?

「違法」ではありませんが規定違反にはなりますね。
H1bの申請の時にその地域での同職種の平均給与の95%以上を支払うという条件があるはず。
なので実際の給料があまりに低いとH1bの更新時に却下になる要件になります。
政府としても当てにしているカネ(税金)が入ってこないならVisaを蹴るでしょう。
