南CAにある日系の個人事業主の会社で働いていました。
(私自身はグリーンカード保持者でフルタイムのポジションで働いていました。)
今年9月まで毎月の残業時間が20時間をとうに超えていましたが、8時間を過ぎた勤務時間も時給は同じ時給でしか支払われておらず、それを指摘したところ、9月より既に改めたので現在は違法ではないので、過去の残業代(時給x1.5)は会社は支払う義務はないと言われました。
9月以降は基本は残業なし、でも仕事量は変わらないので結局残業になるがその分は任意でのボランティア残業になるので会社としては違法ではないと言われました。
また、学生ビザで働いている社員に関しては、週20時間を過ぎて働いた分は日本の支社からの給料として別途払われており、勤務はアメリカでも給料は日本で出ているので違法ではないと言っています。
これらは本当に違法ではないのですか？
教えてください、宜しくお願い致します。

HRがしっかりしているところはそういうのもちゃんとしてるんですけどね。
狂ったように忙しくてランチ抜きで働いていたら怒られました。その日は働いた9時間プラス1時間ランチ手当をつけてくれましたし、9時間のうちの1時間は1.5倍の手当ついていました。
会社としてはどんなに忙しくてもきちんと休憩とランチは取るように言われました。それくらい会社としてもやっておかないといけないんだと思います。
会社は訴えられても困るのでその対策もあると思いますが、ブラックですね、あなた様の会社。
解決したら転職するといいですね。頑張って👍
