サーバーのお仕事をされている方にお聞きしたいのですが、TIpはどのように貰っていますか？直接聞いた訳ではないので分かりませんが、先日気になったので計算したところお店に３０〜４０%のチップが毎回入っているようです。そこから時給の分や他の方に支払われているのであれば納得できません。皆さんのお店はどうでしょうか？日本人オーナーでは当たり前と聞きますが、それがまがい通っている事が不思議です。雇用側にも意見はあると思いますが法律は法律です。当方、グリーンカード保持者です。

#6さん〝まがい″の意味列記お疲れ様です。私もその意味は承知していますが〝まがい通る″という用法は無いのではないか、と思った次第です。
トピ主さん、トピずれごめんなさいね。それで、ご不満は、ご自分のチップの分け前が少ないということでしょうか。How to share tips in restaurants で検索してみてください。色々出てきますがこれといった決まりはないようです。ただ、一つはっきりしているのは#8さんの言われるように、雇用主と管理職は手を付けてはいけないということのようです。アメリカでは日本と違って、はっきり、と言わないとダメです。頑張って！

カリフォルニア州の法律にあるLabor Code Section 351にちゃんと書いてある。
オーナーに話しても変わらないのであれば、成功報酬の弁護士に相談して訴えればいいです。
