What is the policy at your apt? I know that most policy on noise is from 10 pm to 6 am. Is the person above you making noise during this hour? If so, you can appeal to your apt owner and tell the owner that you have to move out because the living condition is unbearable. Tell the owner that noise is so bad, it is making your life miserable. Since the disturbance is not your fault, you should be able to get your security deposit. Your contract with the lease should be made with providing you a livable condition. Don't back down. Call the police when the noise get back again. This will prove that the noise is back. So what if your name is on police record? Do you have a criminal record? Do you have a situation that will turn bad if police is involved? If not, stand up for yourself. I've experienced the same situation with you. I called the police, made a claim to the apt manager and apt security, but the situation was not taken care. So, I went to the owner and informed that I'm moving out. Since the unbearable condition was created by the person next to me, I have the right to move without any penalty. I move out giving the owner 30 days notice with my security deposit back. Since this is a civil matter, the person above you can't be moved out by police. There is only two options. You move out or bear the noise. I know it's crazy but that's the reality.

そのボクシングエクササイズのクラスは不法に開かれていると思うので、市のBusiness　Zoning　Commissionだとかに連絡してみては。もしその方がビジネスとして開業しているならまず、１）ビジネスライセンスを取得する必要がる２）このようなビジネスを借家やアパートでは開業できないの２つの理由で市が協力してくれるかもしれません。また、上からの振動でものが壊されたりした場合、ビデオとかにその場面を収めて証拠として保管してください。それからアパートの管理人へのクレームは書面で提出したのなら、精神的苦痛のクレームで管理人・会社を訴えるこもできると思うのですが。

funlovingmarkさんと同じ意見で、そういう場合は大抵違法のクラスなので立場としては上の兄ちゃんのほうが弱いはずです。でももう弁護士を立てて動いてる・・・・？見たいなので状況はわかりませんが､夜間のNoiseでない限り自分がバンバン動かない限り結構放っておかれます。アパートのオーナーでもマネージャーでも、クレームした日付と時間を自分で記録しておいてくださいね。送信データがちゃんと記録されているFAXなんかも使えます。後で自分がきちんとコレに対していろいろ行動していることと、アパート側がクレームに対して何の処置もしなかったことが証明されますから。向こうから連絡があった日も記録してください。
被害者は自分なのに何で自分がこんな思いをしなきゃいけないの？ってだんだん悲しくなるけど、がんばってください。
あと、会社にもし保健室っぽいところがあれば、そこへ行ってこういう理由で眠れず、精神的にこういう状態だ、とDocumentしてもらったりしてくださいね。あと警察を呼ぶと２度目から名前が残る・・・とかいうのはちょっと変な話ですよね。多分１回目からちゃんと記録されているはずです。別に自分が加害しているわけではないので記録に名前があろうが関係ないと思いますけど。でも私にはわかりませんのでやっぱりちゃんとした情報が得られるところから聞いたほうがいいかもです。
弁護士を雇う、という手もあります。サインする前に自分に支払いが発生する可能性のある場合は何か、とか知っておく必要がありますが、弁護士も暇じゃないのでお金にならないケースは最初から手を出しません。だから行ってみて相談する価値はあると思います。
