複数の弁護士に相談したのですが
回答がまちまちなので
経験者の方
よろしくお願い致します
Ｈ１ーＢ ＶＩＳＡ
退職後、すぐに仕事が見つからず
数ヶ月後に転職する場合は
帰国してから
１．再度新規申請
4月申請
10月許可
２．転職先から Ｉ－797が
入手できれば
大使館に行かずに入国できるのでしょうか
どちらでしょうか

２が正解です。前に取得したビザ、Ｉ－７９７で一度出入国はしなければなりませんが、大使館でビザを取得する必要はありません。ただ、転職の際は猶予期間は１０日です。その間に次のスポンサーでchange of employerの申請ができなければ本来はすぐ帰国しなければなりません。

その場合は１がいいんじゃないでしょうか?そうすれば前のＨ－１がクリアになるのでその後から丸々６年使えますし。

日本にもどってからアメリカで仕事を探すのは難しいと思いますので、見つかった時に考えたらどうでしょう?今から１年以上先のことをあれこれ考えていても無駄だと思いますよ。移民法はよく変わるので今できていることが１年後にできるかどうかは全くわかりません。その時にまた調べてみたらどうでしょう?
