先日、車をあてられました。運転手は車を借り、車の持ち主が保険に加入してました。相手の保険会社は、運転手が保険に入っていないから、払わないと主張しており、私側の保険会社は相手の保険会社が払うことになっているといいます。運転手は払わないといっており、どうしても修理が必要でお金も必要です。どうしたら、よいのかわかりません。だれかよいアドバイスをいただけないでしょうか。

これ自体は合法だと思います。
車を保険をかけなければいけないとはカリフォルニアの法律で決まっていますが、
運転手が保険を持たなければならないとは決まっていなかったと思います。
＞相手の保険会社は、運転手が保険に入っていないから、払わない
これも筋は通っています。
＞私側の保険会社は相手の保険会社が払うことになっているといいます。
ここが納得いきませんね。あなたの保険のpolicyはどうなっていますか？
保険のPremiumによって額は変わりますが、Property damage liabilityが
$100,000/accidentなどと決まっているはずです。
あなたが払い続けてきた保険料は、あなたが誰かに損失を与えた時のものではなく、
あなたが誰かに車を当てられたり怪我させられた時に支払われるためのものです。

自分の保険会社にまかせるしかないと思いますが。
結果、相手が払う事になっても、相手が現段階でごねている場合、自分の手元にCHECKが届くまで時間がかかる可能性もあると思います。
どうしても修理が必要なら、保険会社が事故ダメージの見積もりをとった後、とりあえず自己負担で修理した方が良いのでは。
