There are two types of J-1 visas: intern and trainee. As a rule of thumb, interns stay for 12 months and trainees stay for 18 months, but there are many different J-1 visa programs. The shortest program is 4 months. The tricky part of the J-1 visa is that you have to stay outside the US for at least 2 years after the visa expires. After that, switching visas is a bit tricky.

[About Fixed Term Employment Contract （ Limited Term Work ）]

I have seen several past cases of Fixed Term Employment Contracts so far, so I will share what I know about them.

Please read the following only on the assumption that the Overpayment is not due to illegal causes such as out-of-state stay filing, intentional overfiling, spoof filing, etc., but due to simple errors in paid leave reporting, etc., and "expected to be resolved eventually"!

"Your son started a 40 hour/week Federal job from mid-May through July, which is DISQUALIFIED because it exceeds his WBA, but he is going to keep filing because this job ends in mid-July."

I suggest you get a certificate （ dated for the start and end of the work period, signed by the employer ） from HR at the Federal job that the work is for a limited time from mid-May through July. Or if you have a contract copy that contains similar information, that would still be fine. If you submit the certificate or contract copy to the UI office, it will not be misinterpreted as "Quit （ Quit ） yourself".

There have actually been quite a few cases in the past where a fixed-term employment contract was misunderstood as a "Quit" because the applicant did not submit a certificate or a copy of the contract on his/her own.

In conclusion, you will not lose your UI eligibility. In either case, you will need to update your UI account with the Federal Jobs Employer Update. The procedure for updating your employer information is the same as #301 in the "PEUC September Extension Program （ Third PEUC ）" topic.

You do not have to file weekly if your Federal work salary reliably exceeds your WBA or 40-hour work week （ but you do need to update your employer information addition ）. Some people file properly every week even if they exceed. Either is fine, the rest is up to the individual.

Last year, UI accounts were automatically suspended after a few months of not filing weekly.

Are you in a position to file weekly even with Pending due to overpayments ？ If you can If so, you should file weekly for hours worked and labor income for the week without waiting for your paycheck to be deposited. If you do not know your weekly labor income, I think you can ask HR and they will find it out for you.

Part-time is a layoff, so Job Search activity is required. However, I can't find an answer on the Job Search website as to whether or not you need to do a Job Search while working more than 40 hours per week on a fixed-term contract with WBA, so please ask the call center about that.
