Vivinavi Los Angeles民事で訴えられたが、弁護士を雇うお金がありません

悪いことはしていないのに、誤解が大きなことに発展し、民事で訴えられてしまいました。最初は弁護士にお金を払って頼っていましたが、追加請求ばかりされて、もうお金も底をつきました。財産は何もなく破産の申告をする予定です。今までの弁護士には、「裁判にこのままだと負ける。」「払えないならバイバイ。」と言われました。相談できる相手もなく、途方に暮れています。お金のない人が裁判に負けても払うお金がなければ、どうなるのでしょうか。民事ならお金を払えなくても逮捕されたりしない、という話も聞いています。でも、こんな状態だと不安です。どなたか、私にアドバイスを下さいませんか。よろしくお願い致します。

皆さん適当な事書いてますね！
どのような件で訴えられたのか分かりませんが、民事で訴えられた時はあくまでも民事です。財産をすべて没収されることはありません。生きていく上で必要なお金は没収されません。しかし、持ち家、車などがある場合処分させられます。以上は個人が告訴された場合です。
会社の代表として告訴された場合はまったく別です。

USA.comさん、私の友人の場合は、会社の代表として民事で告訴されているのですが、その場合、どうなるのでしょうか。

有限会社か株式会社かで異なります。

この状況だと、破産をお勧めします。 破産したと同時に支払いの義務もなくなります。しかも、破産後また７年後に新しくスタートもできます。＃４さんの入国の件ですが、それは破産せずに払わない人に適応されるのでぜんぜん心配する必要はありません。

＃４の催促はまずありえません。アメリカの民事判決は日本では一切役に立ちません。日本では紙切れ同様です。
