こちらの法律に詳しい方、どうか教えて下さいませ。
非営利団体(NPO)と慈善団体(Charitable Organization→以下CO)の違いがわかりません。
自分でも調べているのですが、決定的な違いがわかりません。
両方とも非課税団体。NPOはその団体の中で発生した収益を団体の持ち主やそこで雇われて
いる人のお給料にあててもいいけれど、COはその団体の中で発生した収益をお給料にあてる
ことはできず、その団体が運営していくための費用に利用(還元?)されなければならない。。。。
ここまで合ってますか?
もし長年NPOでやっていた団体が運営形態は何も変わっていないのに、ある時から突然COに変更する事って
可能なのでしょうか。。。。可能なら、COになってからもお給料はそれまで通り団体の運営者や授業員に
支払われていることは違法になりますか?
2016年にDep.of Justiceがそれまでのルールを変更したので宗教団体や教育機関は書類提出免除になりました。
と言うことは、どこからも監査を受けずどれだけ収益があってのその団体の中ではやりたい放題?という
ことなのでしょうか。。。。

法律に詳しくないけどトピ主さんがNPO=慈善団体と思っていて混乱してるのは分かる。NPOは慈善活動やってる団体だけでなく業界団体やホームオーナーアソシエーション(HOA)など慈善活動以外の組織がいろいろある。チャリティーは公共の福祉となる活動してると行政に認められないと駄目なはず。チャリティーで働いてる職員への給与支払いは全く違法じゃない。レッドクロスなんてトップの役員達への高額な報酬がよくやり玉にあがってる。どういう監査されるのか知らないけど事務費用と実際の活動費用の割合が公開されてるから、寄付するのを決めたり活動に参加する前にそういったものをチェックしろとメディアなんかでよくアドバイスしてる。営利団体より監査は緩いっていうのはたまに聞くからある程度融通がきくのかもね。

情報をありがとうございます。レッドクロスのことを知ると、まさしくその通りですよね。
チャリティでもトップは高額な報酬を得ている。。。。
下記に書かれていることを読む限りは、チャリティ団体はそのサービスによって発生した金額は、サラリーにしては
いけないとなっているのですが、、、、
私が知りたいのは、それまで何十年もNPOで活動していた団体が、ある時突然チャリティ団体に申請して
認められたことなのです。しかも2016年にDep.of Justiceがそれまでのルールを変更し、宗教団体や教育機関は
書類提出免除になってすぐにチャリティ団体に申請して認められたのです。。。でもやっている事はNPO団体だった
時と何も変わらず、お給料もかわらず支払われている。だったらどうしてチャリティに変更する必要があったのか。。。
どうしてもその理由を知りたいのです。チャリティにすることで何がメリットなのか。。。
Non Profit
Do not confuse by the name of an organization. Even if it is a non profit organization, it may not actually be a charity. A non profit organization is just another name for a business entity except that it does not make profits. If there is a surplus, such companies set it aside for salaries. The only point to note is that a non profit company does not report profits, or in other words, it is not there to make money.
Charity
A charity is an organization that is involved in activities such as relief operations or to fight against illiteracy, ailments and other social cause. The money at the disposal of a charity is meant to be spent on these social causes only. A charity raises money through donations and has a workforce that is not salaried; workers often hold honorary posts and offer their contribution voluntarily. Thus it is clear that a charity is similar to a non profit organization in the sense that it too does not make profits.
Difference between Charity and Non Profit
One notable difference between a charity and a non profit organization is the way they are taxed. While a non profit organization is treated as any other normal company involved in business activities, charities are accorded special status by the authorities and get special concessions because of the social work they do for the society.

トピ主があげてる英文のチャリティー説明文は一般的なコンセプトを述べてるだけ。チャリティーのために活動しててる人達は組織から給料もらってやってるわけじゃないという説明してるだけ。チャリティーが職員に給料払ってはいけないという意味の文じゃない。
組織の違いについてググったら下記のような記事が出てきた。
Charity taxes & donations
Many types of nonprofit organizations are eligible for various forms of federal tax-exempt status under Section 501(c) of the Internal Revenue Code, with public charities and private foundations defined as 501(c)(3) organizations.
What most clearly distinguishes 501(c)(3) charities from other nonprofits, however, is that donations to 501(c)(3) organizations are tax-deductible to their donors.
Come tax time, charities have the following filing options:
Form 990, a Return of Organization Exempt from Income Tax form
Form 990-EZ, Short Form Return of Organization Exempt from Income Tax form
Form 990-N, the Electronic Notice (e-Postcard) for Tax-Exempt Organizations not Required to file form 990 or 990-EZ
Form 990-F, the Return of Private Foundation
Which tax form the organization files depends on the type of charitable organization (public or private) plus the amount of their gross receipts and total assets. If a public charity’s gross receipts are less than or equal to $50,000, then it will file form 990-N. If a public charity’s gross receipts are between $50,000 and $200,000, and if its total assets are less than $500,000, the organization can file either form 990-EZ or form 990. If a public charity’s gross receipts are greater than or equal to $200,000, or if its assets equal or exceed half a million dollars, the organization must file form 990. All private foundations, regardless of income and assets, must file form 990-PF.

上記の文章から考えるとチャリティー団体になると寄付した人が寄付金をtax-deductibleに出来るようになるのでそれが理由っぽい。でもそんなに気になるなら団体に直接聞くのが一番手っ取り早いと思うが。

そのページ全部読め。下の方にサラリー出して良いと書いてある。チャリティー団体になる利点もググればいろいろでてくるのにここで質問する意味わからん。

どの文がそういう説明してんの?見当たらんが。
暇つぶしにあげたトピっぽい。それか「何十年もNPOで活動していた団体が、ある時突然チャリティ団体に申請して
認められた」ので不正を疑っててそのことに突っ込みいれて欲しいのかもしれん。
