Many customers who pay their bill by credit card also pay the tip on top of their card, but I get it by check as well. The tip is also included in the 1099, so I pay the GEtax. I know that tips are also taxed, but do you also do it that way ？?

U.S. Department of Labor Finds Oahu Restaurant Owner Allowed Managers to Give Tip Share and Refused to Pay Kitchen Workers Overtime
Investigation Results in Recovery of $170,000 in Unpaid Wages and Penalties for 13 Workers

Honolulu - Honolulu restaurant owner allowed manager to illegally control a portion of workers' tips, averaging 55 per week A recent federal investigation uncovered facts that made it difficult for employees to earn a living by refusing to pay overtime wages to cooks who worked an average of 55 hours per week.

An investigation by the U.S. Department of Labor's Wage ・ and Hour Division found that Rinka restaurant owner ・ R-International Inc. violated the Fair Labor Standards Act, resulting in $85,000 in unpaid wages for 13 employees and R-International Inc. was cited for violating the Fair Labor Standards Act and $85,000 in unpaid wages to 13 employees and a penalty of the same amount was collected. The department also lent the employer $10,000 in civil penalties for its egregious violations.

"The owner of Rinka Restaurant violated the law by refusing to pay the full amount of tips earned by its employees and by refusing to pay the required overtime to its cooks, demonstrating an abusive disregard for workers' rights," Honolulu Wage ・ Labor Hours Division Director Terrence ・ Trotter said. This incident is a warning that violating federal law can be very serious. We encourage all employers to contact us or use the U.S. Department of Labor's online resources before implementing potentially non-compliant practices."

Since 2016, the Wage ・ and Hour Division has reported that the Western Region conducted more than 2,650 investigations in the restaurant industry and recovered $24 million in unpaid wages for more than 15,300 employees. The department's Honolulu District Office
has conducted 228 of these investigations, found violations in 219 cases, and recovered more than $1.4 million in unpaid wages for nearly 1,700 employees.

I recently moved here from California.
When I look at restaurant jobs, I often see that the server's paycheck (hourly rate) often includes tips.
Is this legal in Hawaii? ？ Is it not illegal because it is higher than the minimum? Please let me know if you know!
