HERMOSA BEACH CITY COUNCIL APPROVES URGENCY ORDINANCE TO REGULATE E-BIKE USE

Urgency Ordinance Now in Effect; Addresses Growing Number & Increased Use of Electric Bikes Locally

At its June 4 Special Council Meeting, the City Council unanimously voted to adopt an Urgency Ordinance that further regulates the use of electric and motorized bicycles in Hermosa Beach. The Urgency Ordinance went into effect immediately upon Council approval.

The Special Council Meeting was held in response to concerns related to the safety and use of electric bikes. In passing the Urgency Ordinance, City Council found that the misuse of e-bikes presented a current and immediate threat to the Hermosa Beach community’s public peace, health, safety and welfare.

To address these concerns and protect public safety, the approved Ordinance amends the City’s existing Municipal Code in light of the growing number and increased use of electric bikes locally.

“We are committed to ensuring the safety of residents and visitors to Hermosa Beach,” said Mayor Justin Massey. “This Ordinance provides our public safety personnel with additional tools to better protect everyone who shares our roads and public spaces.”

The Urgency Ordinance includes the following requirements and restrictions for e-bikes and any other electric or motorized conveyance (i.e. motor-driven cycle, pocket bike or electric motorcycle), and fines for violating these rules range from $250 to $1000:


* No person shall ride or operate an electric bicycle or any other electric or motorized conveyance in an unsafe manner that constitutes a danger to themselves or others.

* All e-bike operators and passengers under the age of 18 must wear a properly fastened helmet.

* No electric bicycle or any other electric or motorized conveyance shall be allowed on the Greenbelt (the landscaped trail that runs parallel between Ardmore and Valley Drive in Hermosa Beach).

* Operating a bicycle, electric bicycle or any motorized/electric conveyance under the influence of alcohol or drugs is strictly prohibited (by the California Vehicle Code and the Urgency Ordinance).

* Transporting a passenger on an electric bicycle or any motorized/electric conveyance is prohibited unless the passenger uses a separate seat that is attached to the conveyance.

* Juveniles under the age of 18, who are cited for violating this Ordinance may have their electric bicycle impounded, to be released to a responsible adult upon payment of a fee.

The Urgency Ordinance also regulates the rental of e-bikes within city limits. No later than August 4, 2024, all businesses and persons who provide electric bicycles for rent in the City must equip each such vehicles with geofencing technology that prevents use of the electric motor on the Strand, Pier Plaza, the Greenbelt and any other places in the City where electric bicycles are not allowed to operate.

This Urgency Ordinance does not restrict the safe use of electric or motorized conveyances by physically disabled persons as defined under the Americans with Disabilities Act and is exempt from the California Environmental Quality Act (CEQA).
